U.S. domestic companies and foreign companies producing food for U.S. consumption will have to comply with the new FSMA 204 requirements.

Section 204 of the FDA (Food and Drug Administration) Food Safety Modernization Act (FSMA) designates foods for which additional traceability record-keeping requirements are necessary throughout the food supply chain, from farm to fork.

This list of foods subject to the new requirements includes fresh vegetables (cucumbers, fresh herbs, leafy greens, peppers...) and fresh fruits (melons, tropical fruits). Full list HERE

Anyone who manufactures, processes, packages or holds food included on the Food Traceability List will be required to maintain records containing Key Data Elements associated with specific Critical Tracking Events; and to provide information to the FDA within 24 hours or within a reasonable timeframe agreed by the FDA.

Since this food traceability regulation requires entities to share information with other entities in their supply chain, the compliance date for all those subject to the record-keeping requirements is Tuesday, January 20, 2026.
